2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 120B of the Indian Penal Code and sections 30a, 32 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 1884 liters illicit liquor was recovered from the truck of which petitioner is the registered owner.

4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case on suspicion. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.64271 of 2023(2) dt.17-10-2023 2/2 for bail. He submits that petitioner is the owner of the vehicle from which there is recovery of illicit liquor, as such, he cannot escape responsibility.

6. Considering the aforesaid facts, prayer for bail of the petitioner is refused.
