ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State.

The petitioner is in custody since 12.10.2015 in connection with Manihari P.S. Case No.145 of 2015 registered for the offences under Sections 394 and 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that actually no such occurrence has taken place, rather the petitioner has been named on account of village politics. Even if the allegations are to be believed, the main allegation is squarely against one Sanarul Haque and not against this petitioner.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the

No.3823 of 2016 (2) dt.09-02-2016 2/2 petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned court of Smt. Saba Alam, Judicial Magistrate, 1st Class, Katihar, in connection with Manihari P.S. Case No.145 of 2015.
