JUSTICE SANJAY PRIYA ORAL ORDER 30-06-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bhagwanpur Hat P.S. Case No. 52 of 2016 instituted for the offence under Sections 323, 363, 366, 354, 376 and 511/34 of the Indian Penal Code.
As per written report the allegation against the petitioner is that he took the daughter of the informant to Delhi and confined her in a house for several days and established physical relationship with her and also forced to marry with him. The informant anyhow managed to run away to the place of her sister. Thereafter, she called her brother and returned to the village. She gave information about the occurrence to the Police on 11.2.2016 but no case was registered. Then she sent a letter to
Patna High Court Cr.Misc. No.18470 of 2017 (3) dt.30-06-2017 2/2 the Superintendent of Police on 15.7.2016 but no case was registered. Thereafter, complaint case was filed on 29.3.2016 which was sent to Police Station under Section 156(3) Cr. P.C. and Bhagwanpur P.S. Case No. 52 of 2016 was registered. The victim girl has been examined under Section 164 Cr. P.C. wherein she has levelled specific allegation against the petitioner of confining her in a house in Delhi and forcibly establishing physical relationship with her and forcing her to marry with him.
In such circumstances, keeping in view the specific allegation against this petitioner, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
