JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks regular bail in connection with (Ramgarh Chowk O.P.) Lakhisarai P.S. Case No. 420 of 2019, disclosing offences under Sections 364, 366(A) and 34 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act. As per F.I.R., petitioner said to have kidnapped the daughter of informant.

Submission of learned counsel for the petitioner is that allegation is false and concocted and as a matter of fact the girl has gone out of her own sweet will, which will appear from her statement recorded under Section 164 Cr.P.C., in which, she has stated that she was taken to Punjab and after one month, she came back but there is nothing in her statement that she tried to inform her family members. Moreover, petitioner has been in judicial custody for six month and ready to abide by any

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -I-cum Special Judge, Lakhisarai, in connection with (Ramgarh Chowk O.P.) Lakhisarai P.S. Case No. 420 of 2019 subject to the condition that petitioner shall cooperate in disposal of trial and make himself available as and when required by the Trial Court.
