The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420/406/323/379/34 of the Indian Penal Code.

According to F.I.R. the informant had given Rs.10,000/- to this petitioner to manage loan of Rs.1,00,000/- from the bank. The petitioner did not manage the loan nor refunded the money.

Submission of the learned counsel for the petitioner is that the petitioner is a simple farmer. He had purchased some clothes from the shop of the informant, which was damaged one and for refund of the same the alleged occurrence of assault took place and other allegations are concocted one. Considering the aforesaid submission, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court in connection with Bhabua Police Station Case No.537 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
