JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. C-101 of 2018, disclosing offences under Sections 498A/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
Case is under Section 498A of IPC with an allegation of demand and torture.
At the very outset, it has been submitted by the learned counsel for the petitioner that matter has been settled between the parties and the opposite party no.2 is residing with the petitioner.
Heard learned A.P.P. also.
In such view of the matter, let the petitioner, above
Patna High Court CR. MISC. No.58312 of 2019(4) dt.18-11-2019 2/2 named, surrender before the court below on 02.12.2019 along with the opposite party no.2. Once both the parties appeared, the learned court below shall verify from them about their marital status. If being satisfied that they are peacefully residing together, the learned court below shall confirm the provisional bail granted to the petitioner, vide order dated 16.09.2019, otherwise, the petitioner has to pray for regular bail. Accordingly, this application is disposed of with the above observations.
