Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467, 468, 120(B) of the Indian Penal Code, u/s 66 of I.T. Act and u/s 3/10 of Bihar Examination Control Act, 1981.

As per the prosecution case, on 08.05.2022 the informant got information that question paper of 67th BPSC Combined (Preliminary) Examination had gone viral in the social media leading to registration of FIR against unknown. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the confessional statement of co-accused. It is alleged that

It is further submitted that save and exceptional statement of co-accused, there is no other material against this petitioner to show his involvement in the aforesaid crime. Petitioner claims clean antecedent.

Learned counsel appearing for the State and the E.O.U. opposes the prayer for anticipatory bail. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Sadar, Patna in connection with E.O. PS case No. 20/ 2022, subject to conditions laid down u/s 438(2) of the Cr.P.C.
