Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 504 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that in the background of petty dispute between the parties the petitioner No. 1 Subodh Yadav assaulted to the son of the informant Kali Charan Manjhi with iron rod on his head. Petitioner No. 3 Foto Yadav assaulted co-villager of the informant Muneshwar Manjhi on his head with iron rod. It is further alleged that Shiv
Patna High Court Cr.Misc. No.6150 of 2016 (2) dt.08-02-2016 2/2 Balak Rajwanshi was assaulted with bamboo on his head by petitioner No. 1. The informant was abused by the female members.
It is submitted by learned counsel for the petitioners that injury of the three injured have been found to be simple of marginal size. There is counter version of the occurrence and five persons have received injuries from the petitioners' side.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Nawada SC/ST P.S. Case No. 68 of 2015, pending in the Court of learned Chief Judicial Magistrate, Nawada. With the observations above, the application stands disposed off.
