JUSTICE SHIVAJI PANDEY ORAL ORDER 19-07-2017 Heard learned counsel for the petitioners and learned counsel for the State as well as the informant. The petitioners seek anticipatory bail in a case instituted for the offences under Sections 366A/34 of the Indian Penal Code.

Allegation has been made that petitioners took away the victim girl for the purposes of marriage. An affidavit has been annexed to this application (Annexure-2) from which it appears that both are living as wife and husband. Certified copy of statement made under Section 164 of the Code of Criminal Procedure has been produced which also does not disclose that any force has been applied.

Patna High Court Cr.Misc. No.26875 of 2017 (3) dt.19-07-2017 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Shyam Ram and Sanjay Kumar Ram, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No.47 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
