One day prior to the alleged occurrence, informant and her husband were assaulted by the petitioner and others but admittedly, no case was lodged for the occurrence and on the next day, it is stated that the petitioner and other FIR named accused took the deceased from his house and subsequently, his dead body was recovered near a bridge.

Admittedly, none has seen the actual killing of the deceased. The submission on behalf of the petitioner is that deceased was killed by Bablu Mandal, maternal uncle of the deceased, and even if it assumed to be true, that there was some land dispute between Bablu Mandal and deceased, petitioner does not have any concern and as a matter of fact, being co-villager, petitioner has been implicated in this case.

Patna High Court Cr.Misc. No.5581 of 2016 (2) dt.15-02-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Munger in Kharagpur P.S.
