JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught in course of investigation and one looted mobile of Lava company was recovered from his conscious possession but submission on behalf of the petitioner is that the seized mobile was not put on Test Identification Parade and moreover, having more or less similar allegation, co-accused, Rudra Pratap Mishra has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the

Patna High Court Cr.Misc. No.4067 of 2016 (2) dt.09-02-2016 2/2 petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar, Judicial Magistrate 1st Class, Aurangabad in connection with Kutumba P.S. Case No. 58 of 2015.
