By filing this writ application, the petitioner has prayed for issuance of an appropriate writ in the nature of Mandamus commanding the respondent Authorities to issue appointment letter of the petitioner as a Block Teacher against the visual handicapped seats on the basis of merit list, in light of the judgment/order dated 25.11.2023 passed by the District

Patna High Court CWJC No.14275 of 2024(2) dt.19-09-2024 2/3 Appellate Authority, Vaishali, Hajipur and also in light of the judgment/order dated 02.04.2024 passed by this Court in CWJC No. 1942 of 2024.

At the very outset, learned counsel for the petitioner submits that the petitioner has filed a detailed representation before the District Magistrate, Vaishali, Hajipur (respondent no.4) to take an appropriate action against the concerned officials of Education Department of Zandaha Block for non-compliance of the order of the Appellate Authority, but till date no action has been taken by the respondent concerned.

4. In view of the submission made by learned counsel for the petitioner, in my view, no useful purpose would be served keeping this writ application pending.

5. Accordingly, this writ application is disposed of with a direction to the petitioner to file a fresh representation before the District Magistrate, Vaishali, Hajipur (respondent no.4) along with the supporting documents within a period of two weeks from today for redressal of his grievances and respondent no.4 is well advised to consider the representation of the petitioner and pass a reasoned and speaking order within six weeks from the date of receipt of the representation filed by the petitioner after affording an opportunity of hearing to the petitioner or his counsel.

6. It is made clear that the District Magistrate, Vaishali, Hajipur (respondent no.4) shall be held responsible for noncompliance of this order within the stipulated period.

7. With the aforesaid direction, this writ application is disposed of.
