Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Prosecution allegation, in short, is that motorcycle of the informant was snatched by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.05.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the FIR. The name of the petitioner has transpired on the basis of confession of co-accused. There is

Patna High Court CR. MISC. No.59731 of 2019(2) dt.01-10-2019 2/2 no recovery of any incriminating articles from the possession of the petitioner. The petitioner has not been put on T.I.P. On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Angarh Police Station Case No.05 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
