The petitioners apprehend their arrest in connection with Chandi(Weina) P.S. Case No.146 of 2019 registered under Sections 341, 323, 354(A), 379, 307, 504 and 506/34 of the Indian Penal Code.

The accusation is that due to previous scuffle in between the children, four persons, named in the F.I.R., including the petitioners along with some unknown entered into the house of the informant Sunita Devi and started to take her at a lonely place by dragging and catching her hair. When the

Patna High Court CR. MISC. No.59242 of 2019(2) dt.19-09-2019 2/3 informant made protest, then they started to cause assault to the informant through lathi and danda and took her earring. When Abhay Kumar Singh, the co-villager of the informant, rushed in rescue of the informant, then he was also assaulted, due to which he sustained fracture injury in his hand. Learned counsel for the petitioners submits that due to previous scuffle in between the children, the occurrence of "Maar-Peet" took place between the parties in which the petitioners' side also sustained injury regarding which on the basis of the fardbeyan of Saraswati Devi, the mother of the petitioner no.2, Chandi (Weina) P.S. Case No.147 of 2019 was also instituted against the prosecution party. Moreover, there is allegation against the petitioners and others to cause injury to the informant and Abhay Kumar Singh but their injury report is not available on the record.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Chandi (Weina)
