The petitioner apprehends his arrest in connection with Tikari (Panchanpur) P.S. Case No. 202 of 2019, registered under Sections 379 and 411 of the Indian Penal Code, Section 15 of the E.P Act and Sections 4 and 21 Rule MM(D&R Act), Rule 4/40 of the Bihar Small Mines Rule 1972 and Rule-6 Sub 4/5(a), 15(c) and 8(a) of the Bihar Mine (IMT) and Bhandran Prohibition Rule 2003.

The accusation is that in course of checking, on seeing the informant along with other police personnel, the driver of tractor attached with trailor loaded with illegal sand, succeeded to flee away.

No.58457 of 2019(2) dt.17-09-2019 2/2 Learned counsel for the petitioner submits that the petitioner is the owner of seized tractor attached with trailor, in fact, his tractor was taken by the driver for fare purpose and petitioner has no concerned with the seized illegal sand. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-VI, Gaya, in connection with Tikari (Panchanpur) P.S. Case No. 202 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
