ANJANA MISHRA ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 07.09.2015 in connection with Bikramganj P.S. Case No. 105 of 2015 registered for the offence punishable under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the allegation of theft has been levelled against the petitioner, however no recovery has been made from his conscious possession. It is further submitted that petitioner has been in custody since five months. It is further submitted that vide annexure-2 to this petition, which is an order dated 08.01.2016 passed in Cr. Misc. No. 757 of 2016, co-accused, Birju Yadav,

Patna High Court Cr.Misc. No.4889 of 2016 (2) dt.08-02-2016 2/2 who disclosed the name of the petitioner, has already been granted privilege of regular bail by a Bench of this court. Considering that name of petitioner has surfaced on the confessional statement of co-accused made before the police, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, Rohtas (Bihar) in connection with Bikramganj P.S. Case No. 105 of 2015.
