JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard Sri Uday Kumar, learned counsel for the petitioner and Sri Ganesh Prasad Singh, learned Addl. Public Prosecutor.

The petitioner, apprehending arrest in C.B. Case No.59/16 registered for the offence under Section 47(a) and 48(2) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail, in the event of her arrest or surrender. Learned counsel for the petitioner submits that the petitioner is owner of the bus, from which 18 liters of foreign liquor was recovered.

Learned Addl. Public Prosecutor has opposed the

Patna High Court Cr.Misc. No.21732 of 2017 (2) dt.01-07-2017 2/2 prayer for anticipatory bail.

However, considering the nature of accusation and considering the fact that the petitioner is owner of the bus, there is no reason to deny the prayer for extending the privilege of anticipatory bail. Let the petitioner, namely, Smt. Suchita Chaudhary @ Suchitra Chaudhary, in the event of arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna City, district-Patna in connection with C.B.. Case No.59/16, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
