The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147/148/149/341/342/323/324/353/224/307 of the Indian Penal Code.

Prosecution case is that the police went to investigate the Parbatta (Maraiya) P.S. Case No.390/2015 when arrested petitioner no. 1 Ranjan Chourasiya, who bite on the right hand of the informant when other persons assaulted him with bricks and got released petitioner no.1. It is alleged that the accused persons also snatched Sonata wrist watch from Ramendra

Patna High Court Cr.Misc. No.4360 of 2016 (2) dt.01-02-2016 2/2 Kumar Yadav, who was also a member of the police party. It is submitted by learned counsel for the petitioners that the accusation has been levelled due to collusion of motorcycle of the informant with the rickshaw of the petitioner no.1 for the same Parbatta (Maraiya) P.S. Case No.390/2015 was registered when the villagers made protest against the in action of the police, the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the nature of accusation it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Parbatts (Maraiya) P.S. Case No.391/2015, pending before the learned ACJM, Khagaria.

With the above observation, this application is, accordingly, disposed off.
