JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Manjhagarh P.S. Case No. 335 of 2018 registered for the offences punishable under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act. Allegation as per FIR is of recovery of 504 litres of liquor from the field of one Jagat Singh and petitioner succeeded in fleeing away.
Submission of learned counsel for the petitioner is that FIR itself shows that the field is of Jagat Singh and petitioner has no criminal antecedent and nothing has been recovered from his possession.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest
Patna High Court Cr.Misc. No.961 of 2019(4) dt.14-02-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Gopalganj, in connection with Manjhagarh P.S. Case No. 335 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
