2. By way of this writ application, the petitioner has prayed for the following reliefs:- (a). For a direction to the respondents for taking appropriate action against accused persons by confining them behind bar who are habitual offender and whose names are in the F.I.R. bearing Parbatta P.S. Case No. 96 of 2023 registered on 31.05.2023 for the offences alleged under Sections 341, 323, 147, 148, 149, 427, 379, 307, 504, 506 of I.P.C., which was instituted on the written complain of the petitioner but despite of passing of more than 15 months no action was

(b). For a direction to the respondents to ensure law and order be maintained at the place and for safety and security of the petitioner and his family by taking appropriate action against accused persons who with the help of antisocial elements want to deprive in peaceful enjoyment of life and livelihood of the petitioner and his families which is fundamental right guaranteed by the Constitution of India which defines the life means the life with dignity and peace.

For the aforesaid reliefs, as prayed by the petitioner, he is given liberty to approach the Senior Superintendent of Police, Bhagalpur with an application for the reliefs sought above and if the Senior Superintendent of Police, Bhagalpur finds substance in the application of the petitioner, he will pass appropriate orders in this regard.

4. With the aforesaid observation, this application is disposed of.

5. It is made clear that this Court has not expressed any opinion on the merits of this case and the prayer of the petitioner.
