JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 308, 379, 504, 566, 34 of the Indian Penal Code.

The prosecution story, in brief, is that on 7.12.2014 at about 9 P.M. while the informant was returning home, accused persons, who were in intoxicated stage started abusing and assaulting the informant and accused Santosh Singh put him down and with intent to kill him, badly assaulted on his abdomen and chest and the petitioner took out Rs. 15,000/- from the pocket of the informant.

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent and he has been falsely

Patna High Court Cr.Misc. No.19549 of 2015 (2) dt.04-09-2015 2/2 implicated in the present case. There is no allegation of assault against the petitioner. The allegation of assault is against coaccused Santosh Singh. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanada at Biharsharif in connection with Rahui P.S.Case no. 374 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
