2. This is an application for commanding and directing the respondent authorities to appoint the petitioner as Nagar Primary Teacher under Chakiya Nagar Primary Teacher Employment Unit, in terms of the selection on the basis of inter se merit, with all consequential benefits attached to the post. Alternatively, the petitioner prays for a direction to the concerned District Teacher Employment Appellate Authority to

Patna High Court CWJC No.14874 of 2025(2) dt.09-09-2025 2/2 decide the petitioner's case in accordance with law, and for issuance of such other order or direction for which the petitioner may be found legally entitled to in the facts and circumstances of the case.

3. At this stage, considering the nature of the dispute, where factual evidence/material would be required for proper adjudication, and since a forum is already provided under the statute for redressal of such grievances, the petitioner seeks permission to withdraw the present writ application in order to approach such statute.

4. Permission is granted.

5. Accordingly, the writ application stands disposed of.

6. However, if the District Appellate Authority finds that the case of the petitioner requires consideration, in that case, it shall be open for the District Appellate Authority to give indulgence in the matter.

7. It is made clear that this Court has not expressed any opinion on the merits of the case.
