2. The petitioners seek regular bail in connection with Ramdas Rai Ka Dera P.S. Case No. 34 of 2025 registered for the offence under Sections 30(a) and 37 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 445.17 liters of illicit liquor have been recovered.
4. Learned counsel for the petitioners submits that the petitioners are quite innocent, and they have falsely been implicated in this case. The petitioners are in custody since 16.07.2025. The petitioner no. 2 has one criminal antecedent
Patna High Court CR. MISC. No.63620 of 2025(2) dt.23-09-2025 2/2 i.e., Simri P.S. Case No. 327 of 2021 whereas the petitioner no. 1 claims clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Buxar in connection with Ramdas Rai Ka Dera P.S. Case No. 34 of 2025 subject to conditions that:- 7(i). The petitioner no. 1 will mark his attendance at the Amnour Police Station, Saran at Chapra on the first & third Sunday of each month and the petitioner no. 2 will mark his attendance at the Ramdas Rai Ka Dera Police Station, Buxar on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioners; (ii). At the time of accepting the bail bonds of the petitioner no. 1, the Court below shall verify the fact whether the petitioner no. 1 has clean antecedent or not. If it is found that the petitioner no. 1 has clean antecedent then only his bail bonds shall be accepted by the Court below.
