2. The petitioner seeks bail in connection with Benipatti P.S. Case No. 246 of 2024 instituted for the offences under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1-b)a, 26, 27, 35 of the Arms Act.
3. Accusation against the accused persons is of being involved in committing the murder of the informant's father by firing.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case on the basis of suspicion and thereafter,
Patna High Court CR. MISC. No.63307 of 2025(4) dt.14-11-2025 2/3 his confessional statement was recorded. Learned counsel further submitted that there is no eye-witness to the occurrence. Learned counsel for the petitioner submitted that except the own confessional statement of the petitioner, there is no material against him to show his involvement in the alleged occurrence and that too has no evidentiary value in the eye of law. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.02.2025 and has one criminal antecedent.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner stating that this petitioner has himself confessed his guilt and has also disclosed the manner in which he, in connivance with other accused persons committed the murder of the informant's father. Learned counsel further submitted that even as per the postmortem report, the death was caused due to haemorrhage and shock caused by firearm injury.
6. Considering the aforesaid facts and circumstances of the case as also there being ample material agianst the petitioner in the case diary, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
