JUSTICE SUDHIR SINGH ORAL ORDER 27-11-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are languishing in custody since 24.11.2014 in connection with Atri P.S. Case No. 181 of 2014 for the offences instituted under Sections 304(B) and 201/34 of the IPC.
The prosecution story, in brief, is that the marriage of Lalti Devi was solemnized with Lalan Mandal about five years back. It is alleged that till one year, she was kept happily and then the informant took her daughter to her natal place and soon thereafter, the informant's daughter went to her matrimonial home. Thereafter, her in-laws started torturing for which a
Patna High Court Cr.Misc. No.19352 of 2015 (3) dt.27-11-2015 2/3 Complaint Case No. 67/12, Trial No. 1633/2013 was filed in the court which is pending. The informant has further stated that on 26.09.2014 in the night, a message came from her daughter's matrimonial home to her father that Lalti Devi is serious then on 28.09.2014, the informant went to her daughter's home Sevtar. There, the villagers told that the petitioners alongwith Lalan Manjhi, Khushbu Manjhi, Yamuna Manjhi have killed Lalita Devi setting her on fire and performed the funeral also. The informant was out of station on 26.09.2014. Due to that, he could not reach to his daughter's home on 27.09.2014. He reached there on 28.09.2014 and lodged the FIR against the petitioner and other coaccused.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 24.11.2014 and the charge sheet has been submitted in the case. There is no allegation of tampering of the evidence against the petitioners. The petitioner no. 1 is the mother-in-law of the deceased and petitioner no. 2 is the father-inlaw of the deceased. They are in separate in mess and property from the husband of the deceased. It is further submitted that the husband of the deceased is in custody.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
