JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rajgir P.S. Case No. 350 of 2018 registered for the offences punishable under Sections 30(a)(d) of the Bihar Prohibition and Excise Act.
Allegation is of recovery of 513 litres of liquor from the Tata 407 vehicle of the petitioner.
Submission of learned counsel for the petitioner is that because of the fact that documents seized from the vehicle showing the name of the petitioner, he has been made accused in this case and he was not present there.
Heard learned APP also.
Having heard both sides and in view of recovery of huge quantity of liquor, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender
Patna High Court Cr.Misc. No.80051 of 2018(3) dt.14-02-2019 2/2 and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
