The petitioner apprehends his arrest in Dharahara P.S. Case No. 175 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 3(x) of the SC/ST Act.

The police officer lodged his fardbeyan stating therein that Urmila Devi and her son assaulted him and abused by naming his caste.

It is submitted that the petitioner is not named in the FIR. Name of the petitioner for the first time figured in the case in para - 16 of the case diary and it is alleged that the petitioner assaulted the informant with Lathi.

Considering the facts aforesaid and the fact that the

No.21184 of 2015 (2) dt.07-07-2015 2/2 name of the petitioner figured in the case at belated stage, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Dharahara P.S. Case No. 175 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
