In this case, the petitioners are apprehending their arrest in connection with Mansoorchak P.S. Case No. 54 of 2015 registered for offences under sections 147, 447, 323, 379, 504 of the Indian Penal Code.
An allegation has been made that the accused persons have tried forcibly to construct a hut, when it was objected by the Informant, an allegation has been made that Ashok Mahton, petitioner no.1, assaulted with Khanti over the head of Ayush. The allegation against the petitioner no.2 Chandan Kumar is that he has assaulted with bamboo.
Patna High Court Cr.Misc. No.33017 of 2017 (2) dt.21-07-2017 The police, after investigation, submitted chargesheet under Section 341, 323, 504 of the I.P.C. but, the court below has taken cognizance under Sections 323, 324, 341, 308 and 504 of the I.P.C.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Ashok Mahton @ Toy and Chandan Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st, Begusarai in connection with Mansorechak P.S. Case No. 54 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
