This is an application for grant of anticipatory bail in connection with Sakatpur PS case no. 80 of 2018 registered for the offences punishable under Sections 447, 341, 323, 354(B) 354(D)/ 379, 504, 506/34 of Indian Penal Code.

The allegation is regarding the petitioners having sent obscene photographs on the whatsapp of the informant and on being objected to the same, the petitioners are said to have assaulted the informant.

The learned counsel for the petitioners submits that the petitioners are innocent and a bare perusal of the case diary would show that obscene photographs sent on whatsapp have not been

No.57685 of 2019(3) dt.04-12-2019 2/2 recovered from the mobile of the informant, hence it is submitted that the allegation levelled against the petitioners are apparently false. The petitioners are said to be having a clean antecedent. Having regard to the facts and circumstance of the case, I deem it fit and appropriate to admit the petitioners to the privilege of anticipatory bail. Accordingly, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Darbhanga in connection with Sakatpur PS case no. 80 of 2018 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
