JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Section 3 of the Railway Property (Unlawful Possession) Act.

700 kgs. of coal were recovered from the Baghoi Kusha Halt railway station when one Sheo Kumar was apprehended, who disclosed the name of the petitioner, who escaped from the scene.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and only on confession of co-accused, the petitioner has been roped in the present case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.4645 of 2016 (2) dt.04-02-2016 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Dehri-on-sone, RPF Post Case No.2/2015, pending before the learned Railway Judicial Magistrate, Gaya.

With the above observation, this application is, accordingly, disposed off.
