The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 409/34 of the Indian Penal Code.
The petitioner was Headmaster In-charge of the school. Allegation is that out of the total money allotted for construction of the school building, the petitioner misappropriated rupees one lakh and odd.
Submission of the learned counsel for the petitioner is that the case diary would reveal that after institution of the First Information Report, the work has already been completed by the petitioner and after submission of final measurement report, the bill has been cleared.
Patna High Court Cr.Misc. No.20875 of 2017 (3) dt.01-07-2017 2/2 Considering the aforesaid submission, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur/successor Court in connection with Lalganj Police Station Case No. 298 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
