18-06-2015 Heard learned counsel for petitioners and learned Addl. Public Prosecutor.
Five petitioners, apprehending their arrest in Cheriabariarpur P.S. Case No. 151 of 2014 registered for the offence under Section 307 & other allied sections of the Indian Penal Code, have prayed for grant of anticipatory bail. Learned counsel for petitioners submits that in relation to land dispute, occurrence had taken place and the informant side were agressors and as such, on the basis of ferdbeyan of petitioner no. 2, an F.I.R. was lodged from the side of petitioners, vide Cheriabariarpur P.S. Case No. 150 of 2014 for the
Patna High Court Cr.Misc. No.19479 of 2015 (2) dt.18-06-2015 2/2 offence under Section 307 & other allied sections of the I.P.C. He submits that both sides sustained injury in the scuffle. In view of the facts and circumstances, particularly; the fact that there was case and counter case in between the parties and the fact that there is general and omnibus allegation, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail.
Accordingly, in the event of their arrest or surrender before the court below within a period of one month from today let the petitioners, namely; Madan Singh, Meghan Singh, Gaurav Kumar, Saurabh Kumar and Gulshan Kumar be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Cheriabariarpur P.S. Case No. 151 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
