The petitioners being the parents and brothers of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioners is permitted to make necessary correction in paragraph 1 of the petition. The basic accusation is of torture for non-fulfillment of dowry demand.
Patna High Court Cr.Misc. No.50435 of 2014 (2) dt.30-04-2015 2/2 It is submitted by learned counsel for the petitioners that the husband of the complainant has been granted provisional bail vide Criminal Miscellaneous No. 598 of 2015 since the complainant and her husband agreed to reconcile the issue. Considering the thrust of accusation against the husband, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Complaint Case No.C-1/1658/2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
