2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 354, 307, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution , petitioner No. 1 assaulted the son of the informant by means of Farsa and petitioner No. 2 Chandan Yadav assaulted the grandson of the informant by means of lathi in which they sustained injury .

4. It is submitted on behalf of the petitioners that there

Patna High Court CR. MISC. No.62987 of 2023(2) dt.17-10-2023 2/2 is general and omnibus allegation of assault against these petitioners. Injury allegedly caused by petitioner Nos. 1 and 2 are simple in nature. There is case and counter case between the parties and both sides sustained injuries. Co-accused Pinki Devi has also lodged the F.I.R, against the prosecution party vide Laukaha P .S. Case No. 256 of 2021. Petitioners claim clean antecedent.

5. Learned counsel for the State oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D. J . M., Jhanbjarpur, District- Madhubani in connection with Laukaha P.S. Case No. 255 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
