JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 7 of Essential Commodities Act.
It is alleged that 80 bags of urea fertilizer loaded on the tractor of the petitioner were seized.
It is submitted by learned counsel for the petitioner that neither the petitioner is named in the FIR nor he is connected with the seized fertilizer and the tractor of the petitioner was used as a public carrier. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12

No.19650 of 2015 (2) dt.29-04-2015 2/2 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikrahana at Motihari in connection with Chiraiya P.S.
