JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Basantpur P.S. Case No. 68 of 2015 for the offences instituted under Sections 468, 471, 406, 4090 and 420 of the Indian Penal Code and Sections 55A, 465 and 206(7) of the Companies Act.
As per the prosecution case, it is a case of fraud institution in the name and style of 'Vaibhav Pariwar India Project Limited' at Basantpur Bazar, Siwan and started deposit money of Rs. two hundred per month for two years and when the amount matured and the complainant went for payment, all the accused
persons later on fled away by locking the premises. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have been made accused due to mistake of fact. Petitioners happened to be the agent of a finance company. As per the allegation, the informant had deposited amount of Rs.3,000/- in the said finance company through the petitioners and other co-accused. It is further submitted that the petitioners is ready to deposit an amount of Rs.3000/- in the court below which may be release in favour of the informant.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners shall deposit an amount of Rs.3000/- in the court below which shall be release in favour of the informant and on doing so, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Basantpur P.S. Case No. 68 of 2015 (Complaint Case No.821 of 2015) on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan, subject to the conditions
as laid down under Section 438(2) of the Code of Criminal Procedure.
