Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

Petitioners are in custody since 26.06.2019. They have got no criminal antecedents. Allegation is that they induced the informant to swear an affidavit to the effect that informant had already purchased the truck from which liquor was recovered in the State of Bihar. The affidavit was sworn at the instance of the petitioners and the petitioners had malicious

Patna High Court CR. MISC. No.59388 of 2019(2) dt.27-09-2019 2/2 intention to save the real culprit and compel the informant to go to jail. The informant disclosed the entire incident to the Police and thereafter, F.I.R. was lodged. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Aurangabad Muffasil Police Station Case No.145 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
