The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
The prosecution is that co-accused Kailash Verma sold 7 kathas of land of the informant to the petitioner in connivance with the Circle Officer, Circle Inspector and Revenue Karamchari.
It is submitted by counsel for the petitioner that the petitioner is a bonafide purchaser and on the date of purchase the land was recorded in revenue records in the name of the father of Kailash Verma, who executed the sale deed and Jamabandi has been cancelled by the superior authorities after
Patna High Court Cr.Misc. No.6108 of 2016 (2) dt.08-02-2016 2/2 execution of the sale deed.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the thrust of accusation is against co-accused Kailash Verma, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 713 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
