JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Mali P.S. Case No.11/2017 registered for the offence under Sections 379, 411, 420/34 of the Indian Penal Code and Section 40 of Bihar Mines Act, has prayed for grant of bail in the event of his arrest or surrender, primarily on the ground that one of the co-accused, who is none else but owner of the vehicle in question, on which alleged illegal sand was recovered, has already been extended the privilege of anticipatory bail by order dated 05.06.2017 passed in Cr.Misc.No.22732 of 2017.

Learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail. However, he was not in a position to

Considering the fact that co-accused, who is owner of the vehicle in question, has been extended the privilege of anticipatory bail, there is no reason to deny the same prayer to the petitioner. Let the petitioner, namely, Ranvijay Kumar Singh @ Ran Vijay Singh, in the event of his arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No.11/2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
