The petitioner, apprehending his arrest in Barachatti P.S. Case No.340/2016 registered for the offence under Sections 272, 273, 120(B) of the Indian Penal Code and Sections 47(a), 48(2), 54, 63 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that the petitioner is owner of the vehicle in question, from which about 123 bottles of Indian Make Foreign liquor was

Patna High Court Cr.Misc. No.21813 of 2017 (2) dt.01-07-2017 2/2 recovered. He submits that the petitioner was not present at the time alleged seizure nor any material was found against him save and except the fact that the petitioner is owner of the vehicle. Considering the nature of accusation as well as the fact that the petitioner is owner of the vehicle in question, let the petitioner, namely, Randhir Singh, in the event of his arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Sherghati( Gaya) in connection with Barachatti P.S.Case No.340/2016, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
