The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 468, 471 and 120-B of the Indian Penal Code and 3/4 of Bihar Examination Act. On 16.02.2017, the informant (Block Development Officer, Aurangabad) received informations that Samir Raj, a Teacher of Uttar Narayan Classes, circulated solved question of Intermediate examination, 2017 (Physics) on mobile phones of the examinees. Thereafter a team was constituted and Samir was intercepted. On query, Samir disclosed the involvement of Satish Kumar, Amarjeet Kumar, Jitendra Kumar, Ravi Ranjan @ Pramod and Bablu Kumar also in the crime.

Patna High Court Cr.Misc. No.17761 of 2017 (4) dt.01-07-2017 2/2 Learned counsel submits that the petitioner is working on contract basis in Government office and doing full time job and he is not a professor of Physics or Math. He further submits that mobile phone, from which the solved answer were said to be circulated, does not belong to the petitioner. The petitioner has got no criminal antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner, above named, be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case no. 55 of 2017 subject to the conditions as laid down under Section 438 (2) Cr.P.C. with further condition that the petitioner would not physically absent for two consecutive dates at stretch, till charge is framed, failing which his bail bonds would be cancelled.
