Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Dalsinghsarai P.S. Case No. 291 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.09.2021, charge-sheet has been submitted, is a person with clean antecedent and allegation is of recovery of liquor from the house of Mukesh Kumar, Raj Kumar and Raja, as detailed in the F.I.R.

No.374 of 2022(2) dt.02-03-2022 2/2 Learned counsel for the petitioner submits that from perusal of the allegation made in the F.I.R., it would be manifest that nothing was recovered from the possession of the petitioner and petitioner came to be arrested, based on suspicion. Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted, is a person with clean antecedent and nothing was recovered from his possession, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.500/- (Rupees five hundred) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Samastipur in connection with Dalsinghsarai P.S. Case No. 291 of 2021.
