2. The petitioner seeks bail in connection with Sonepur P.S. Case No. 80 of 2021 instituted for the offences under Sections 401, 413, 414/34 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.

3. As per prosecution case, the police has recovered 120 mg. smack like substance, a loaded country-made pistol, Bhujali and knife from the co-accused Anand Kumar. It is alleged that the petitioner fled away from the place of occurrence.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.61526 of 2025(2) dt.08-09-2025 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The petitioner was not apprehended on spot and his name has transpired in this case on the basis of the disclosures made by the apprehended co-accused Anand Kumar recorded before the police which has no evidentiary value in the eye of law. He further submits that the apprehended co-accused Anand Kumar has already been granted bail by a Co-ordinate Bench of this Court vide order dated 28.02.2022 passed in Cr. Misc. No. 45684 of 2021. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has three criminal antecedents and is languishing in judicial custody since 03.06.2025 without any rhymes or reason.

5. Learned counsel for the petitioner again submits that the co-accused namely Naga Rai has been granted bail by a Co-ordinate Bench of this Court vide order dated 17.11.2022 passed in Cr. Misc. No. 41650 of 2022.

6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Having heard rival contention of both the parties

No.61526 of 2025(2) dt.08-09-2025 3/3 and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner and the prayer for bail being based on parity, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sonepur P.S.
