Informant claims to have seen the alleged occurrence but submission on behalf of the petitioner is that informant is not eyewitness of the alleged occurrence nor any proposed prosecution witness has claimed to have seen the actual killing of the deceased. Moreover, post mortem report of the deceased also negates the claim of the informant.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ravindra Nath Tripathi, Judicial Magistrate, Ist Class, Jehanabad/concerned court in Kurtha P.S. Case no. 75/2014.
