The petitioner is accused in connection with Muzaffarpur Town P.S. Case No. 340 of 2014 registered under Sections 387, 504 and 506/34 of the Indian Penal Code. The allegation of informant, Baidhnath Singh, is that after lodging Kanti (Muzaffarpur) P.S. Case No. 316 of 2013, he was being threatened on mobile, regarding which, informant submitted an application before the Superintendent of Police on 05.12.2013. On 19.05.2014, informant received a call through mobile no. 9096247983 demanding ransom of Rs.5,00,000/- (Rs.
five lac) to withdraw the case otherwise we will kill your family members. The person who talked on mobile disclosed their names as Sanjay Kumar Singh, Arvind Kumar Singh (petitioner) and Rajeev Kumar Singh, all are resident of village Madhopur. Learned counsel for the petitioner submits that petitioner is the agnate of informant, Baidhnath Singh, in fact, son of the informant died in motor accident and according to the information of the informant, post-mortem was done and thereafter dead body was disposed off but later on after one month informant filed a complaint case bearing Complaint Case No. 772 of 2013 which is the basis of the F.I.R. of Kanti (Muzaffarpur) P.S. Case No.
316 of 2013 implicating the name of the petitioner and four others for the offence under Section 302 of the Indian Penal Code regarding the death of his son and the present case has also been lodged only to undue pressure and harass the petitioner and others. It is further submitted that the mobile number as detailed in the F.I.R. is not belonged to the petitioner. It is further submitted that petitioner is in custody since 06.02.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.
Sub-Divisional Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No. 340 of 2014. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
