Heard the learned counsel for the petitioners and learned APP for the State.

These are applications for regular bail on behalf of the petitioners for the offences alleged under Sections 08/(c)/20 of the NDPS Act, 1985, registered in connection with

Patna High Court CR. MISC. No.72531 of 2021(2) dt.30-05-2022 2/3 Muzaffarpur Sadar P.S.Case No. 549 of 2021 and NDPS Case No. 114 of 2021.

As per allegation, the police intercepted a Bolero vehicle. On search, 150 gms of ganja was recovered concealed near the gear of the vehicle and the person who was driving the car disclosed his name as Raju Kumar. Second person who was sitting beside the driver disclosed his name as Birendra Kumar and one mobile set was recovered from his possession. The petitioners Md. Ibran @ Md. Imbran and Md. Ujale were also sitting in that vehicle and 150 gms of ganja was recovered from possession of Md. Imbran.

The learned counsel for the petitioners has submitted that petitioners are the persons of clean antecedents and the recovered ganja is in small quantity. They are in custody since 13.08.2021.

Considering the above facts and circumstances as well as the clean antecedents of the petitioners, let them be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned 8th Addl. Sessions Judge, Muzaffarpur in connection with Muzaffarpur Sadar P.S.Case No. 549 of 2021 and NDPS Case No. 114 of 2021, subject to the following

Patna High Court CR. MISC. No.72531 of 2021(2) dt.30-05-2022 3/3 conditions:-

1. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

2. At the time of furnishing bail bonds, the petitioners shall file affidavit(s) to the effect that they shall not indulge themselves in future in the similar type of offence. If it is found so, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
