2. The petitioner is in custody since 31.12.2022 in connection with Bhagwanpur P.S. Case No. 307/2022 registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 20/8/22 of the NDPS Act, cognizance was taken under Section 20(b)(ii)(b) of NDPS Act.

3. As per the prosecution case, 10.420 kg ganja has been recovered form the bag which kept in a bag on motorcycle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due enmity. It is further submitted that the alleged recovery has not been made from the conscious possession of the petitioner. He further submits that police submitted chargesheet without FSL Report.

5. Considering the huge quantity of Ganja, I am not inclined to grant him bail. It is, accordingly, rejected.
