ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 22.07.2019 in connection with Paliganj P.S. Case No. 250 of 2019 (Special Case No. 6509 of 2019) registered for the offence under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioners submits that only because they were arrested from the motorcycle in an inebriated state they were taken into custody and the alleged recoveries has been saddled on their shoulders. It is further submitted that the petitioner no.1 has similar antecedent and petitioner no.2 has two similar antecedent but they are willing

In view of the aforementioned facts and circumstances and that there was no recovery from the conscious possession of the petitioners and because they were found in a drunken state, let the petitioners, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the court of learned Special Judge, Excise, Patna in connection with Paliganj P.S. Case No. 250 of 2019 (Special Case No. 6509 of 2019.
