JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents and brother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Section 304B of the Indian Penal Code. The accusation is of killing the daughter of the informant after two years of marriage for non fulfillment of dowry demands. The informant has claimed that the victim suggested him that the kerosene oil was poured by the husband of the victim whereas the mother in law lit the fire.

It is submitted by the learned counsel for the petitioners that the informant came to know about the occurrence, as per own admission, on 9.12.2014 but the case was lodged on 29.1.2015.

No.21541 of 2015 (2) dt.20-05-2015 2/2 The fardbeyan of the victim (Annexure 2) was recorded in the hospital during treatment in presence of witnesses Lavkesh, Binod Kumar Dubey and Rabindra Nath Tiwari where she stated that she sustained injury due to accidental fire through earthen lamp. Considering the delayed lodging of the case and the statement of the victim, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Nawanagar P.S. Case No. 18 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
