The petitioner seeks bail in Sahebganj P.S. Case No. 20 of 2013 dated 31.01.2013 instituted under Sections 302/34 of the Indian Penal Code.

This is the second attempt of the petitioner for bail as earlier such prayer was rejected on 03.09.2014 passed in Cr. Misc. No. 33524 of 2014.

No fresh grounds have been made out so as to persuade

Patna High Court Cr.Misc. No.20222 of 2015 dt.12-04-2016 2/2 the Court to reconsider the prayer for grant of bail to the petitioner. Accordingly, the application stands dismissed. However, in view of the fact that no substantial progress has been made with regard to the trial and the petitioner is in custody and suffering due to non-appearance of the other accused, the Court below is directed to expedite the trial and conclude the same within nine months for which purpose the trial of the petitioner, along with those who have appeared, be bifurcated, if so deemed necessary. The trial Court shall also ensure that the same is done so that the timeframe fixed by the Court is adhered to for which it shall use powers vested in it under law and shall fix short dates in the case. Registry shall communicate the order to the Court below through Fax also latest by tomorrow.
